Terms of service
Effective from 2 July 2026

§ 1. General provisions
- These Terms set out the rules for using the website available at peakresidences.co (the "Website") and for the provision of electronic services, including the Newsletter service together with the delivery of the Guide.
- The service provider is Peak Residences spółka z ograniczoną odpowiedzialnością (a Polish limited liability company) with its registered office in Warsaw, al. Niepodległości 235/237 lok. 76, 02-009 Warsaw, Poland, entered in the register of entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw, 12th Commercial Division, under KRS number 0001244345, NIP (tax ID) 7011316035, REGON 544871469, share capital PLN 5,000, e-mail: kontakt@peakresidences.pl, phone: +48 668 242 971 (the "Provider").
- The Terms are made available on the Website free of charge, in a way that allows them to be obtained, reproduced and stored (downloaded and saved).
- The services described in § 3 are free of charge.
§ 2. Definitions
- "User" means any person using the Website.
- "Consumer" means a User who is a consumer within the meaning of Article 22¹ of the Polish Civil Code, as well as a natural person entering into a contract directly related to their business activity where the contract is not of a professional character for that person.
- "Newsletter" means a service consisting of sending the User, to the e-mail address they provide, information about investments, real-estate market analyses and information about the Provider's services.
- "Guide" means digital content: an investor's guide to the Dubai property market in PDF format (market, districts, payment plans, taxes, a due diligence checklist), delivered to the User in connection with ordering the Newsletter.
- "Privacy Policy" means the document describing how personal data is processed, available at peakresidences.co/en/privacy.
§ 3. Types and scope of electronic services
The Provider offers the following services through the Website:
- access to the Website content (investment catalog, articles, informational materials);
- a contact form allowing a message to be sent to the Provider;
- the Newsletter together with delivery of the Guide, under the rules set out in § 6;
- booking a free online consultation call, under the rules set out in § 7;
- a calculator of indicative investment parameters, running entirely in the User's browser, without transmitting the entered data to the Provider.
§ 4. Technical requirements and prohibition of unlawful content
- Using the Website requires: 1) a device with Internet access; 2) a current version of a web browser with JavaScript enabled; 3) for the contact form and the Newsletter: an active e-mail account.
- The Website does not use cookies; it uses the browser's local storage to remember the User's preferences (theme, catalog layout), as described in the Privacy Policy.
- The User must not supply unlawful content, including content infringing third-party rights, good practice or the law.
§ 5. Contact form
- The contact form service contract is concluded when the User starts filling in the form and expires when the message is sent or the User stops filling it in.
- Sending a message does not oblige the User to use the Provider's services. The processing of data submitted in the form is described in the Privacy Policy.
§ 6. Newsletter and Guide
- The Newsletter is ordered by entering an e-mail address in the sign-up form on the Website and confirming the subscription by clicking the link sent to that address (double opt-in). The contract for delivery of the Newsletter and the Guide is concluded upon confirmation, for an indefinite period.
- Under the contract the Provider: 1) delivers the Guide by sending it to the provided e-mail address or providing a download link, no later than 3 days after confirmation; 2) sends the Newsletter no more often than 4 messages per month.
- The services referred to in item 2 are free of charge. In exchange, the User provides the Provider with their e-mail address, processed as described in the Privacy Policy. The contract is governed by the provisions of the Polish Consumer Rights Act of 30 May 2014 concerning contracts for the supply of digital content for which the consumer pays with a price or by providing personal data.
- The Guide is delivered as a PDF; a free PDF reader or a web browser is sufficient to open it. The Provider is liable for the conformity of the Guide and the Newsletter with the contract under the Consumer Rights Act.
- The User may terminate the contract at any time, with immediate effect, without giving reasons and free of charge: 1) by clicking the unsubscribe link in the footer of any message; 2) or by sending a request to kontakt@peakresidences.pl. Termination means the Newsletter is no longer sent.
- The Provider may terminate the contract for important reasons, in particular if the Newsletter is discontinued or the User breaches § 4(3), informing the User at the provided e-mail address.
- A User who does not wish to order the Newsletter may receive the Guide alone by sending a request to kontakt@peakresidences.pl.
§ 7. Booking a call online
- The booking service lets the User arrange a free, thirty-minute consultation call with the Provider themselves, held remotely via a video-conferencing service (Google Meet).
- The booking service contract is concluded when the User confirms the booking of a chosen time. To conclude it, the User provides their name and e-mail address and selects a time; stating the topic of the call is optional.
- After booking, the Provider sends a confirmation with a video-meeting link to the provided e-mail address, and a reminder shortly before the call. The booking is free of charge and does not oblige the User to use any further services of the Provider.
- The User may reschedule or cancel the call at any time, without giving reasons and free of charge, using the link contained in the confirmation message. Cancelling the call is equivalent to terminating the booking service contract with immediate effect.
- Taking part in the call requires a device with Internet access, a microphone and a browser or app supporting Google Meet. The processing of data provided when booking is described in the Privacy Policy.
§ 8. Withdrawal from the contract
- A Consumer may withdraw from the contract for delivery of the Newsletter and the Guide within 14 days of its conclusion, without giving reasons and free of charge.
- Sending the withdrawal statement before the deadline to kontakt@peakresidences.pl is sufficient. No specific form is required; a message such as "I withdraw from the newsletter delivery contract concluded on [date], e-mail address: [address]" is enough. The Consumer may also use the model form annexed to the Polish Consumer Rights Act.
- Upon withdrawal the contract is deemed not concluded. The Provider immediately stops sending messages and processing the e-mail address for the purpose of performing the contract, and confirms receipt of the statement to the Consumer.
§ 9. Complaints
- Complaints about the services described in these Terms may be submitted to kontakt@peakresidences.pl.
- A complaint should include: the User's e-mail address, a description of the problem and the expected resolution.
- The Provider examines the complaint and replies to the e-mail address it was sent from, no later than 14 days after receiving it.
§ 10. Nature of the Website content
- Content published on the Website, including investment descriptions, example rates of return and calculator results, is of an informational and marketing nature. It does not constitute investment, tax or legal advice, nor an offer within the meaning of Article 66 of the Polish Civil Code.
- The rates of return presented are always based on the assumptions stated next to them. Historical results and forecasts do not guarantee future results; the actual return on an investment depends, among other things, on market conditions, property maintenance costs and exchange rates.
§ 11. Personal data
The processing of Users' personal data is described in the Privacy Policy.
§ 12. Amendments to the Terms
- The Provider may amend the Terms for important reasons, in particular changes in the law, changes in the scope or manner of providing the services, or for security reasons.
- The Provider informs Newsletter subscribers of an amendment at least 14 days in advance, at the provided e-mail address.
- A User who does not accept the amendment may terminate the Newsletter contract as described in § 6(5), with effect no later than the date the amendment enters into force.
§ 13. Final provisions
- A Consumer may use out-of-court complaint and redress procedures, including the assistance of a municipal or district consumer ombudsman or a provincial Trade Inspection inspector. Details are available at uokik.gov.pl.
- Contracts concluded under these Terms are governed by Polish law; this choice does not deprive the Consumer of the protection afforded by mandatory provisions of law.
- The Terms enter into force on 2 July 2026.
